Fourth District Court of Appeal Permits Video Conference Oral Argument

On July 14, 2022, the Florida Supreme Court amended Florida Rule of Appellate Procedure 9.320 to allow for requests for oral argument to take place via communication technology. The effective date of the amendment is October 1, 2022. At that time, a request for oral argument to take place via communication technology must be included in the initial request for oral argument authorized by Rule 9.320(a). The court, in the exercise of its discretion, may grant or deny the request of a party or may, on its own motion, order participation in oral argument through the use of communication technology.


Due to the impending rule change, effective immediately, the Fourth District Court of Appeal will accept requests for oral argument which also contain a request that oral argument, if granted, take place via communication technology. Parties who filed a request for oral argument which has not yet been ruled on and did not contain a request for oral argument to proceed via communication technology may file an amended request for oral argument to request that oral argument, if granted by the court, take place via communication technology.
